GENERAL TERMS AND CONDITIONS

ARTICLE 1. DEFINITIONS

1.1 General Terms and Conditions (hereinafter referred to as the “Terms”): the following delivery and payment conditions apply to all sales via www.live-winkel.nl. By placing an order, you agree to these Terms;
1.2 Company: www.live-winkel.nl (hereinafter referred to as “Live-winkel”) is the trade name of dropout-Fashion and is an online store offering clothing and related products to consumers by means of distance selling;
1.3 Consumer: a natural person or legal entity that enters into a distance contract with the Company;
1.4 Agreement: a distance contract concluded between Live-winkel and the Consumer.


ARTICLE 2. APPLICABILITY

2.1 These Terms apply to every offer made by Live-winkel and to every distance contract concluded between the Company and the Consumer;
2.2 These Terms apply at all times to all offers, orders, and agreements concluded through the website www.live-winkel.nl;
2.3 Before the distance contract is concluded, these Terms are made available via our website. Acceptance of an offer or placement of an order implies acceptance of these Terms;
2.4 Deviations from these Terms are only valid if agreed upon in writing. If any provision of these Terms is deviated from, the remaining provisions shall remain fully in force. No rights may be derived by the Consumer from any agreed deviations for future transactions;
2.5 Unless expressly agreed otherwise in writing, Live-winkel does not recognize any general or specific terms or conditions of third parties.


ARTICLE 3. AGREEMENTS

3.1 An agreement is concluded only after acceptance of your order by Live-winkel. Live-winkel reserves the right to refuse orders or to attach conditions to delivery, unless expressly stated otherwise. If an order is not accepted, this will be communicated within five (5) working days after receipt of the order, stating the reason.


ARTICLE 4. PRICES

4.1 All offers made by Live-winkel are non-binding. Live-winkel expressly reserves the right to change prices, particularly if required by (statutory) regulations;
4.2 The prices stated for the products offered are expressed in euros and include VAT. Shipping costs are not included in the stated prices unless indicated otherwise. Before the agreement is concluded, the total price will be communicated via the website;
4.3 Live-winkel cannot be held to price indications that are incorrect, for example due to input, typographical, or printing errors. No rights may be derived from incorrect price information.


ARTICLE 5. PAYMENTS

Payment must always be made in full in advance.

5.1 Payment can be made in various ways as indicated below and during the ordering process. Additional (payment/order) conditions may be imposed on an order. After placing an order, the Consumer will immediately receive an order confirmation by email stating the total costs;
5.1.1 iDeal: If you use online banking, you can securely pay electronically via our website. An electronic payment via the internet is comparable to a PIN payment in a physical store. After placing your order, select the iDeal payment method. You will then be redirected to a screen where you can select your bank and follow the familiar online banking payment procedure. In principle, the payment is processed on the same working day. For more information, please visit the iDeal website;
5.1.2 In the event of bankruptcy or suspension of payments of the Consumer (or an application thereto), all claims of Live-winkel shall become immediately due and payable;
5.1.3 If Live-winkel is required to outsource the collection of its claim, the Consumer shall owe a fixed amount of 15% of the outstanding amount as extrajudicial collection costs. If Live-winkel can demonstrate that higher costs were reasonably incurred, these shall also be borne by the Consumer.


ARTICLE 6. DELIVERY

6.1 All items offered in the online shop are available from stock. However, it may occur that an item is unexpectedly no longer available; in such cases, the Consumer will be informed as soon as possible;
6.2 Live-winkel strives to ship all orders within 1 to 3 working days after receipt of payment. Delivery will be made to the address provided with the order. If the delivery time deviates for any reason, the Consumer will be informed by email. In principle, orders will always be shipped within 1 to 3 working days after receipt of payment;
6.3 Exceeding the stated delivery time does not entitle the Consumer to compensation, termination of the agreement, or non-performance of any obligation arising from this or any related agreement;
6.4 The order must be delivered to the Consumer no later than 30 days after placing the order. If delivery within 30 days is not possible, the Consumer will be informed in a timely manner and has the right to cancel the order free of charge. In such cases, Live-winkel will arrange a refund. This does not apply if the parties have agreed on a different delivery period;
6.5 Partial deliveries are permitted;
6.6 Live-winkel’s delivery obligation is fulfilled once the delivery has been offered;
6.7 In the event of refusal or failure to collect the offered delivery, return shipping and storage costs, as well as the risk of damage or loss of the shipment, shall be entirely borne by the Consumer;
6.8 Products offered are displayed and/or described clearly and truthfully and as completely as reasonably required. However, discrepancies in color, type, text, and/or price may occur;
6.9 Live-winkel is never liable for consequential damage. At Live-winkel, we pack your order with great care and attention. Each package is sealed with Live-winkel seals and tape to ensure it is delivered in its original condition. If a package is delivered with broken seals, an investigation will be initiated with our shipping partners, and Live-winkel cannot be held liable;

6.10 Insured or uninsured shipping? You have two shipping options.
Uninsured: you accept the risk that no compensation will be provided if your package is damaged or lost.
Insured: we bear the risk of damage or loss of your package.


ARTICLE 7. RETENTION OF TITLE

7.1 Ownership of delivered products shall not transfer to the Consumer until the Consumer has fully fulfilled all payment obligations to Live-winkel arising from the agreement(s) concluded in respect of the delivered products.


ARTICLE 8. RETURNS / EXCHANGES

8.1 We do our utmost to inform you about our products via our website. If, nevertheless, you do not wish to keep a product without stating reasons, you have the right to return the product within 14 working days after receipt of the order. To initiate a return, please contact us first via info@live-winkel.nl with the subject “return”. We will request your order number and item number. After email correspondence, you will be informed where to send the return and under which conditions. Please wait for our approval before returning any items;
8.2 During the return period, the Consumer shall handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to assess whether the Consumer wishes to keep it. If the Consumer exercises the right of exchange, the product must be returned to Live-winkel with all supplied accessories and, where reasonably possible, in an undamaged condition and in its original packaging, in accordance with the reasonable and clear instructions provided by Live-winkel;
8.3 Live-winkel only accepts returns/exchanges for which the instructions have been followed. Returns/exchanges received outside the specified period will not be accepted;
8.4 The Consumer is responsible for returning the item(s). Any associated costs are borne by the Consumer;
8.5 Your return will be confirmed by email after receipt of the goods;

8.6 Refunds: The purchase amount of returned items will be refunded within 14 days to the account from which the payment was made. If only part of an order is returned, shipping costs will not be refunded;
8.7 Please note: food products, Scoopies, and items custom-made for you, such as our Pick & Mix products, cannot be returned;

8.8 Orders can always be cancelled. However, if an order is older than 14 days and your items have been stored in your open box for 14 days, we will deduct a 20% handling fee / box rental fee from the refunded amount.

ARTICLE 9. COMPLAINTS

Complaints regarding delivery and/or quality of your order

9.1 We strive to deliver a perfect product. Upon receipt of your order, you must immediately inspect the delivered goods and promptly report any defects in writing. If an item has not been delivered in accordance with your order or does not meet the description on our website, you must notify us immediately by emailing info@live-winkel.nl. This warranty lapses if you attempt to repair the defect yourself without consultation and/or fail to follow the instructions for use.

If you have a complaint regarding an item purchased from us, we would like to hear from you. Please report this immediately by sending an email to info@live-winkel.nl.
We will resolve the issue as soon as possible in consultation with you. This may take up to 14 working days. In all cases, the return instructions provided when submitting your complaint must be followed exactly.
To ensure smooth handling of your complaint, we kindly request that you strictly follow our instructions.


ARTICLE 10. LIABILITY

10.1 Any liability of Live-winkel, its staff, and its products for any damage whatsoever, whether direct or indirect, including business loss, consequential damage, damage to movable or immovable property, or personal injury, is expressly excluded. Live-winkel is also not liable for damage caused by third parties during the execution of the agreement;
10.2 Live-winkel accepts no liability for any damage resulting from the use of its products;
10.3 Any liability of Live-winkel towards the buyer is in all cases limited to a maximum of the invoice amount owed by the buyer under the relevant agreement;
10.4 Live-winkel is not liable for misunderstandings, mutilation, delays, or improper transmission of orders and communications resulting from the use of the internet or any other means of communication between the Consumer and Live-winkel, or between Live-winkel and third parties, unless such issues are caused by intent or gross negligence on the part of Live-winkel.


ARTICLE 11. FORCE MAJEURE

11.1 In the event of force majeure, Live-winkel has the right, at its own discretion, to suspend the execution of the Consumer’s order or to dissolve the agreement without judicial intervention, by notifying the Consumer in writing, without being liable for any compensation, unless such would be unacceptable according to standards of reasonableness and fairness;
11.2 Force majeure is defined as any failure that cannot be attributed to Live-winkel, as it is not due to its fault and is not attributable to it by law, legal act, or generally accepted standards.


ARTICLE 12. APPLICABLE LAW AND COMPETENT COURT

All rights, obligations, offers, orders, and agreements to which these Terms apply, as well as the relationship between Live-winkel and the Consumer, are exclusively governed by Dutch law.
